Breaks There are 3 varieties of breaks you get during your working week. A break that occurs every day of work, is called a rest break, or known as a lunch break, and or any other short breaks taken throughout the day. At the end of your working day, when you go home, this is known as a daily rest; finishing one day before starting another. Weekly rest refers to the whole days you have off during your working week, also known as the weekend. Most of these types of rest are unpaid, apart from the rest breaks (lunch breaks); many of these are paid, but refer back to your contract, as it is not a legal requirement to pay for rest breaks. Adult workers are entitled to a 20 minute break for every 6 hours of work. The break must be taken in one block, and can’t be taken off the end of a working day, must be taken around the middle. You also have the right to at least an 11 hour daily rest between your working days, and 24 hours of no work whatsoever every week.

Working overtime Currently there is no legal right to pay for extra working hours, unless stated by your employer. Again this will be recorded in your contract, as it should include details of overtime pay rates. Many employers will offer you time off instead of paying for your overtime, this should be agreed between you and your employer. You only have to work overtime if your contract states so. You cannot be forced to work more than the 48 hour legal time limit a week. If you are being pushed to work more than this, talk with your employer, if unresolved, think about getting in touch with an Employment Tribunal.

An employment contract is an agreement between an employer and an employee; which sets out there employment rights, responsibilities and duties. These are referred to as the ‘terms’ of the contract. An employment job contract can be made as soon as you accept the job offer, therefore meaning you accepted the terms offered by the employer. Having a written contract could cut out later disputes and help you understand your employment rights. The contract binds you and your employer until it ends; by giving notice or until the terms are changed in agreement between you and your employer.

There is a term referred to as ‘flexibility cause’, where your employer reserves the right to change the terms and certain conditions. However your employer’s changes won’t be unreasonable, as many contracts have an implied term of mutual trust and confidence, requiring them to act honourably. There may be times when either you or your employer wants to change some terms of the contract; this can’t be done without each other’s agreement. If you wish to make a change to one of the terms, speak with your employer and explain why. If they want to change something, they should consult you, explain their reasoning why, and be open to alternative idea you may put forth.

If you or your employer has broken one of the terms set out in the contract, this is referred to as ‘breach of contract.’ If you believe your employer has broken one or more of the terms, check your contract to be sure. If there has been a breach of contract, talk with your employer directly and try to resolve the issue, before making any further more advanced decisions.

If you do decide to take legal action, you can do this through an employment tribunal or through a civil court. However it is cheaper and quicker to go through an employment tribunal, but going through a civil court may get you more compensation. One thing to keep in mind is that your employer may be prompted to take out a counter claim against you if they feel they have one. If you are the one that breached the contract, your employer should come to you directly to try and resolve the issue. If there is a suffered financial loss for your employer because of you, they may make a complaint for damages against you.

"In some instances I deal directly with the tenant, but in other situations I’ll communicate with the lettings agent or the landlord. This is particularly true when it comes to accessing the property and collecting the keys.

"Both instances provide an excellent opportunity to build a relationship with the customer and market our other products and services to them: I view every interaction as a marketing opportunity, because you never know that your next big customer could be the person you’ve recently spoken to."

David has been a gas-elec engineer for over ten years and has renewed his five-year contract for a second term. As a result, he has built up a strong, loyal customer base that trusts his advice and abilities.

"This type of customer relationship means that I am able to identify problems that have appeared since my last visit, and give advice on other safety issues that they may be concerned about," adds David. "While the core gas-elec business model is about safety inspections and services, customer service is paramount. "Depending on the time of day, I will ring the office again to update them on how the day went. By this time it’s normally about 6 pm and time to download the work for the following day, a quick scan just to look at what is planned and then that’s it until the following morning."
